    1. Acceptance of Terms

    By accessing or using Reelative's website, mobile applications, or related services (the "Service"), you agree to these Terms of Service ("Terms").

    If you do not agree, you may not use the Service.

    These Terms constitute a legally binding agreement between you and Reelative, Inc. ("Reelative," "Company," "we," "us," or "our").

    2. Eligibility

    You must:

    • Be at least 13 years old.
    • Have legal capacity to enter a binding contract.
    • Not be barred from using the Service under applicable law.
    • Provide accurate registration information.

    If using the Service on behalf of an organization, you represent authority to bind that entity.

    3. Description of Service

    Reelative provides a private video storytelling and archival platform enabling users ("Creators") to:

    • Record video content
    • Store and archive content
    • Invite designated viewers ("Viewers")
    • Share content privately
    • Purchase subscriptions (web and in-app)
    • Redeem gift subscriptions

    We may modify, suspend, or discontinue features at any time.

    4. Account Responsibility

    You are responsible for:

    • Account security
    • All activity under your credentials
    • Promptly reporting unauthorized access

    We may suspend or terminate accounts to protect the integrity of the Service.

    5. User Content

    5.1 Ownership

    You retain ownership of your uploaded content ("User Content").

    5.2 License to Reelative

    You grant Reelative a worldwide, non-exclusive, royalty-free license to:

    • Host
    • Store
    • Transcode
    • Encrypt
    • Backup
    • Deliver to authorized Viewers
    • Use automated systems to process content for functionality and security

    This license exists solely to operate and improve the Service.

    We do not sell your private video content.

    6. AI & Automated Processing Disclosure

    Reelative may use automated systems to:

    • Optimize video quality
    • Detect abuse
    • Manage storage tiers
    • Prevent fraud
    • Improve system performance

    We do not use private videos for public AI model training.

    7. Acceptable Use

    You may not upload content that:

    • Depicts sexual exploitation of minors (CSAM)
    • Violates intellectual property rights
    • Is recorded without lawful consent
    • Is illegal or abusive
    • Violates privacy or publicity rights

    We may remove violating content and report it to authorities where required.

    8. Viewer Access & Sharing

    Creators control viewer access.

    Viewers receive a limited, revocable license for personal use only.

    We are not responsible for misuse of shared links or viewer behavior.

    8a. SMS / Text Message Terms

    Reelative does not engage in affiliate marketing, lead generation, or the sale of consumer data. SMS messages are sent only to existing account holders for account-related notifications.

    SMS notifications are optional. By entering your phone number and enabling SMS notifications in your account Settings, you expressly consent to receive text messages from Reelative, Inc., including one-time verification codes and optional weekly account notifications.

    Message frequency varies. Verification messages are sent only when requested. Weekly reminder notifications are sent approximately once per week if enabled.

    Message and data rates may apply. You may opt out at any time by replying STOP to any message or by disabling SMS notifications in your account Settings. Reply HELP for assistance, or contact contact@reelative.io.

    We use Amazon Web Services (AWS End User Messaging SMS) to deliver messages. Your phone number will not be sold, rented, or shared with third parties for marketing or promotional purposes.

    8b. Reporting & Enforcement

    If you encounter content on Reelative that you believe violates these Terms, you can report it from inside the app using the Report button on any video. Reports go directly to the Reelative team and are reviewed manually.

    We aim to review reports within 24 hours. Where content is found to violate these Terms, applicable law, or basic safety standards, we may take any of the following actions:

    • Remove the reported video or share link.
    • Revoke active viewer access tokens.
    • Suspend or terminate the recorder's account.
    • Report the matter to law enforcement where required by law (including suspected child sexual abuse material).

    Recorders may also revoke viewer access at any time from Settings. You can reach our team directly at contact@reelative.io.

    9. Digital Estate & Succession

    Reelative is not a fiduciary, trustee, executor, or custodian of digital estate assets.

    In the event of death or incapacity:

    • Access may require verified legal documentation.
    • Court orders may be required in disputes.
    • We may suspend access pending legal review.
    • We reserve discretion in resolving conflicting claims.

    Reelative is not liable for estate disputes.

    10. Subscriptions & Billing

    10.1 Website Billing

    Payments are processed via third-party processors (e.g., Stripe). You authorize recurring charges.

    10.2 App Store Billing

    In-app purchases are governed by Apple/Google policies. Refunds must be requested through the applicable app store.

    10.3 Auto-Renewal

    Subscriptions renew automatically unless canceled before the renewal deadline.

    10.4 Gift Subscriptions

    Gift subscriptions:

    • Activate upon redemption
    • May extend active subscriptions
    • Are non-transferable after redemption
    • Are non-refundable unless required by law

    10.5 Billing Issues

    If payment fails:

    • Access may enter grace status
    • App Store retry policies apply
    • Access may expire if unresolved

    10.6 Cancellation vs. Account Deletion

    Canceling your subscription and deleting your account are different actions with different consequences:

    • Cancellation stops future billing. Your existing videos remain preserved under our operational intent described in Section 11, and family members retain archive access.
    • Account deletion permanently removes your videos, profile, viewers, and share links. Anyone you have shared videos with loses access immediately. After a 30-day grace period during which you may cancel the request by signing back in, the deletion is irreversible and Reelative is no longer obligated to preserve your content under Section 11. You can initiate deletion at Settings → Account → Delete Account, or visit reelative.io/delete-account.

    11. Archival Storage Disclaimer

    Statements regarding long-term archival storage (including "up to 100 years") reflect operational intent, not a guarantee.

    You acknowledge:

    • Storage infrastructure may change.
    • Retrieval may involve delay.
    • Technology may become obsolete.
    • Business circumstances may evolve.
    • Natural disasters, cloud failures, or provider changes may impact access.

    Reelative does not guarantee perpetual preservation.

    12. Cloud Infrastructure Dependency

    The Service relies on third-party infrastructure providers (including cloud hosting and storage vendors).

    We are not liable for outages, data loss, or failures caused by third-party infrastructure providers beyond our reasonable control.

    13. Service Availability

    The Service is provided "AS IS" and "AS AVAILABLE."

    We do not guarantee uninterrupted access.

    14. Intellectual Property

    All software, branding, and proprietary materials are owned by Reelative.

    You may not reverse engineer, copy, or distribute proprietary materials.

    15. DMCA Copyright Policy

    We comply with the Digital Millennium Copyright Act (DMCA).

    We may remove allegedly infringing content and allow counter-notification.

    16. Export & Sanctions Compliance

    You may not use the Service in violation of U.S. export laws, trade sanctions, or embargoes.

    17. Disclaimer of Warranties

    The Service is provided without warranties of any kind.

    We disclaim:

    • Merchantability
    • Fitness for a particular purpose
    • Non-infringement
    • Data preservation guarantees

    18. Limitation of Liability

    To the maximum extent permitted by law, Reelative shall not be liable for:

    • Indirect damages
    • Loss of data
    • Emotional distress
    • Loss of legacy content
    • Lost profits
    • Consequential damages

    Total liability shall not exceed the greater of:

    • $100 USD, or
    • Amounts paid in the previous 12 months

    19. Indemnification

    You agree to indemnify and hold Reelative harmless from claims arising from:

    • Your content
    • Your misuse of the Service
    • Your violation of these Terms

    20. Force Majeure

    We are not liable for delays caused by:

    • Natural disasters
    • Cloud outages
    • Government action
    • Cyberattacks
    • Labor disputes
    • War or terrorism

    21. Arbitration Agreement & Class Action Waiver

    You agree that disputes shall be resolved through binding arbitration administered by the American Arbitration Association.

    You waive:

    • Jury trial
    • Class actions
    • Representative actions

    Arbitration shall occur in California.

    This provision survives termination.

    22. California Consumer Rights

    If you are a California resident: You may request certain consumer information pursuant to California Civil Code Section 1789.3 by contacting contact@reelative.io.

    23. GDPR Notice (EU Users)

    If you reside in the European Union:

    • You may have rights to access, correct, or delete personal data.
    • These rights are described in our Privacy Policy.
    • You may contact us for data access requests.

    24. Assignment

    Reelative may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.

    You may not assign your rights without written consent.

    25. Severability

    If any provision is unenforceable, the remainder remains valid.

    26. Waiver

    Failure to enforce any provision does not constitute waiver.

    27. Entire Agreement

    These Terms constitute the entire agreement between you and Reelative.

    28. Survival

    Sections relating to arbitration, liability, indemnification, intellectual property, and assignment survive termination.

    29. Electronic Consent

    You agree that electronic acceptance constitutes legally binding consent.
